PLAYER WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT BLACKBURN LADIES SOFTBALL LEAGUE.

I, the undersigned Player, acknowledge, agree and understand that:
 

1. I am at least eighteen (18) years of age.

2. I am choosing to play softball with Blackburn Ladies Softball League. Voluntarily and of my own free will, I elect to participate as a member of the softball team and league indicated above.
3. I understand that playing softball has risks and I or other players could get hurt or die. I understand that weather conditions, playing conditions, equipment and other players all impact the safety of the game. I understand that there are certain risks and hazards involved in participating in softball that may result in injury or death to me or other players, including, but not limited to those hazards associated with weather conditions, playing conditions, equipment and other participants.
4. I understand that, by their nature, the actions required to play softball are dangerous and I could get hurt or die. I understand that the very nature of the game of softball is hazardous and risky, including, but not limited to pitching, throwing, fielding, catching and being hit by the ball, swinging the bat, running, jumping, stretching, sliding, diving, and colliding with other players and stationary objects, all of which can cause serious injury or death to me and to other players.

Further, I, the undersigned, agree that in consideration for the right to play as a member of the team designated above and in consideration for permission to play on the field arranged for by the team or league:

1. I accept and assume the risks associated with softball no matter what I am doing at the diamond. I voluntarily elect to accept and assume all risks of injury incurred or suffered by me
(a) while practicing or playing as a member of the team so designated,
(b) while serving in a non-playing capacity as a team member during practice or play by other teams or by other players on my team, and
(c) while on or upon the premises of any and all of the fields arranged for by my team or league for practice or play.
2. I recognize that I cannot hold the league or any of its representatives or associations in any way responsible if I get hurt or die. I release, discharge and agree not to sue the team or league designated above, the Softball Association, or their owners, officers, agents, servants, associations, employees or any other person or entity connected with the team, league, field or Softball Association for any claim, damages, costs or cause of action which I have or may have in the future as a result of injuries or damages sustained or incurred by me from whatever cause including but not limited to the negligence, breach of contract or wrongful conduct of the parties hereby released.

In addition to the above, I further agree that before I step onto the softball diamond, I will sign the Blackburn Ladies Softball League’s liability waiver as required by their insurance carrier. Furthermore, I agree that the Blackburn Ladies Softball League has the right to prevent me from stepping onto the softball diamond, or participating in league practice or play in any capacity, until the liability waiver has been signed by me.

I agree that the Blackburn Ladies Softball League has the authority to withdraw my registration if my payment for the season has not been received by the payment deadline. I must set up any installment payment plans in advance with the Blackburn Ladies Softball League’s treasurer, and I must adhere to the agreed upon payment schedule, otherwise the Blackburn Ladies Softball League has the right to remove me from the league.

I hereby grant permission for the Blackburn Ladies Softball League and its members to use photographs and/or video of me taken at Blackburn Ladies Softball League events held between January 1, 2025 and December 31, 2025. Events may include, but are not limited to: softball practices, clinics, and games held at the softball diamond; social events held in public locations including restaurants, bars and sports venues; softball tournament games, scorekeeping, set-up, and tear-down; volunteer opportunities in the community, possibly held in conjunction with other volunteer organizations. Photographs may be used in print publications, online publications, presentations, websites, social media, and in other communications related to the recruitment and promotion of the Blackburn Ladies Softball League. I also understand that no royalty, fee or other compensation shall become payable to me by reason of such use.

I ACKNOWLEDGE THAT I HAVE READ AND THAT I UNDERSTAND EACH AND EVERY ONE OF THE PROVISIONS IN THIS WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AND AGREE TO ABIDE BY THEM.
